1. About us

ScaleviX (“we”, “us”, “our”) is a digital marketing agency based in Lahore, Pakistan, offering performance marketing, paid advertising, social media management, creative production, brand strategy and web development services.

2. Using this website

You may use this website for lawful purposes only. You agree not to:

• Use the site in a way that damages, disables or impairs it.
• Attempt to gain unauthorised access to any part of the site or its systems.
• Copy, reproduce or republish our content for commercial purposes without written permission.
• Use automated systems to scrape or harvest content or data from the site.

3. Our services

The scope, deliverables, timeline and fees for any engagement are set out in a written proposal, quotation or service agreement. Nothing on this website constitutes a binding offer — work begins only once a proposal is accepted in writing.

We will perform our services with reasonable skill and care, and in line with the scope agreed with you.

4. Client responsibilities

To deliver effective work, we rely on you to:

• Provide accurate information, brand assets, product details and access to the accounts and platforms we need.
• Respond to approvals, feedback and requests within a reasonable time.
• Ensure any material you supply does not infringe third-party rights and complies with applicable law.
• Maintain your own advertising budgets and pay platform costs where these sit in your accounts.

Delays caused by outstanding information, approvals or access may affect timelines and results.

5. Fees and payment

• Fees, currency and payment schedule are stated in your proposal or invoice.
• Unless agreed otherwise, retainers are payable monthly in advance and project fees may require a deposit before work begins.
• Advertising spend is separate from our management fee and is either paid directly by you to the platform or invoiced separately, as agreed.
• We may pause work on overdue accounts after giving reasonable notice.
• You are responsible for any taxes, bank charges or transfer fees that apply.

6. Results and performance

We work to clear performance goals and report on them honestly. However, digital marketing outcomes depend on many factors outside our control — including market conditions, competition, platform algorithms, ad-account history, pricing, product-market fit and your own operations.

We therefore do not guarantee specific results, such as a particular return on ad spend, sales volume, ranking position or lead count. Any figures shown on this website reflect past results for specific clients and are not a promise of future performance.

7. Third-party platforms

Our services often depend on third-party platforms such as Meta, Google, TikTok, Shopify and WordPress. We are not responsible for their availability, policy changes, account restrictions, ad disapprovals or suspensions. Where such issues arise, we will work with you in good faith to find a solution.

8. Intellectual property

Our material

All content on this website — including text, design, graphics and code — belongs to ScaleviX or its licensors and may not be reused without permission.

Client deliverables

On full payment of all outstanding fees, ownership of the final deliverables created specifically for you transfers to you. We retain ownership of our underlying tools, templates, frameworks, know-how and any pre-existing material used to produce them.

Portfolio rights

Unless you tell us otherwise in writing, we may display work we produced for you in our portfolio, case studies and marketing. We will respect any confidentiality restrictions you specify.

9. Confidentiality

Each party agrees to keep the other’s confidential business information private and to use it only for the purposes of the engagement. This obligation continues after the engagement ends.

10. Term and cancellation

• Ongoing retainers run month to month unless a fixed term is agreed.
• Either party may end a retainer by giving 30 days’ written notice, unless your agreement states otherwise.
• Fees for work already performed, and for the notice period, remain payable.
• We may end an engagement immediately if fees remain unpaid, if we are asked to act unlawfully or against platform policy, or in cases of abusive conduct.

On termination, we will hand over access to accounts and assets we manage on your behalf, once outstanding fees are settled.

11. Refunds

Because our work is delivered as time, strategy and creative output, fees for work already performed are non-refundable. If you believe a deliverable falls short of what was agreed, contact us and we will work in good faith to correct it. Any refund or credit is at our reasonable discretion and considered case by case.

12. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for indirect or consequential losses, including lost profits, lost revenue, lost data or business interruption.
• Our total liability in connection with an engagement is limited to the fees you paid us for the services in the three months before the claim arose.
• Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify us against claims arising from material you supply, from products or services you sell, or from your breach of these terms or applicable law.

14. Changes to these terms

We may update these terms from time to time. The “last updated” date shows the current version. Continued use of the website or our services after changes are posted means you accept the revised terms.

15. Governing law

These terms are governed by the laws of Pakistan, and the courts of Lahore, Pakistan have jurisdiction over any dispute — unless your written agreement with us specifies otherwise.
